COMMERCIAL SUPPORT POLICY The WEBSITE has adapted the following modified E-Commerce Principles that have been approved by the American College of Cardiology on its WEBSITE (www.cardiosource.com, not affiliated with the WEBSITE, but an independent site that the WEBSITE has engaged in collaborative activities with in the past) to ensure adherence to the highest ethical standards of advertising and to determine the eligibility of products and services for commercial support on the WEBSITE. The WEBSITE will accept commercial support from industry in the form of advertising and grants as described in these Commercial Partnership Principles. IN USING OR VIEWING THE WEBSITE, YOU AGREE NOT TO ALTER OR MODIFY THE WEBSITE'S PROPRIETARY EMBEDDABLE MEDICAL MEDIA PLAYER OR ANY OF ITS RELATED TECHNOLOGIES. B. You agree to use the embedded video player that is provided and you agree not to access User Submissions (defined below) or WEBSITE Content through any technology or means other than the video playback pages of the WEBSITE itself, the WEBSITE Embeddable Player, or other explicitly authorized means WEBSITE may designate. C. You agree not to use the WEBSITE for commercial use. This policy extends to the use of the WEBSITE Embeddable Player. If you would like to license our technology or media, please contact us for written authorization of the WEBSITE. D. The WEBSITE supports a free and open access to medical information. Consistent with our support of a free and open source policy, it is not the intent of the WEBSITE to provide free content to those who restrict access to and profit from medical education content. Examples of entities that restrict free access to content and profit from medical education content include subscription journals and professional societies. A list of prohibited commercial activities include but are not limited to the following actions taken without WEBSITE's express approval: • Selling access to this WEBSITE • Selling access to enter your website so that people can access media on this WEBSITE. YOU ALSO HEREBY GRANT EACH USER OF THE WEBSITE A NON-EXCLUSIVE LICENSE TO ACCESS YOUR USER SUBMISSIONS THROUGH THE WEBSITE, AND TO USE, REPRODUCE, DISTRIBUTE, DISPLAY AND PERFORM SUCH USER SUBMISSIONS AS PERMITTED THROUGH THE FUNCTIONALITY OF THE WEBSITE AND UNDER THESE TERMS OF SERVICE. F. Any opinion, recommendation, or advice appearing on the WEBSITE is that of the User Submitter and not the WEBSITE. The WEBSITE has no liability in connection with User Submissions. G. The WEBSITE does not promote copyright infringement or infringement of intellectual property rights on its WEBSITE. The WEBSITE cannot independently verify the copyright status of submission. The WEBSITE will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights and if this claim can be verified. WEBSITE reserves the right to remove Content and User Submissions without prior notice and without their permission, at any time for any reason. H. Journal of the American Medical Association (JAMA) does not support the open source dissemination of material from its site, and does not permit redistribution of slides or figures from its Journal. 16. ACCOUNT TERMINATION POLICY A. WEBSITE may at its sole discretion choose to exclude any end user or group of end users from participating in the site at any time for any reason without prior notice. WEBSITE reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement (which WEBSITE cannot police), such as, but not limited to, pornography, obscene or defamatory material, promotion of patently dangerous remedies or procedures, excessive or patently false commercial claims, or excessive length. 17. If you are provided a waiver regarding any single term, this shall not be construed as a waiver regarding any other term.
